  1. GENERAL TERMS AND CONDITIONS
    • These Terms and Conditions will apply to any agreement between us (Fast Line Training Services Limited) for the sale of Courses to you (Agreement). Please review these Terms and Conditions carefully and make sure that you understand them before placing an order for any Courses from our site. Please note that before you make an order you will be asked to agree to these Terms and Conditions. If you refuse to agree to any of these Terms and Conditions, you will not be able to order any Courses from our site.
    • By becoming a client of Fast Line Training Services Limited you enter into a contract by which you:
      • Confirm that you are willing to participate fully in the course.
      • Agree to pay the relevant fees.
      • Agree not to plagiarise the work of others or in any way try to pass yourself off as competent by means of deception.
      • Agree not to use any device, physical or mobile to capture, store or share course content (test papers, material, discussions etc.,) unless expressly allowed to do so
      • Agree to take full responsibility for your actions and opinions.
      • Confirm that you have, or are willing to secure access to, relevant materials where the course necessitates this.
    • We reserve the right to refuse clients for any reason.
    • Face-to-face courses normally run with a suitable minimum of participants. Should a course be cancelled because of a shortage of participants you will be offered a place on an alternative course or a full refund of fees paid.
    • You must accept the End User Licence Agreement (EULA) – which forms part of these terms on the first use of any online facility.
    • Fast Line Training Services Limited reserves the right to terminate any enrolment if it suspects that any part of these terms and conditions have been broken. 
  1. HOW THE AGREEMENT IS FORMED
    • Our course selection pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before finally submitting your order to us. Please take the time to carefully review and check your order on each page of the order process.
    • After your order is placed, you will receive an e-mail from us confirming that we have received your order. However, please note that this does not mean that your order has been accepted.
    • Our acceptance of your order will take place as described in clause 8.
    • We will confirm our acceptance to you by sending you an e-mail to confirm the availability of your course (Confirmation Email). The Agreement between us will only be formed when we send you the Confirmation Email.
    • When booking direct with Fast Line Training Services (as opposed to Online) we are unable to confirm your order until we’ve received a fully completed Booking Form.
    • If we are unable to supply you with a Course, for example, because that Course is no longer available or because of an error in the price on our site as referred to in clause 28, we will inform you of this by e-mail and we will not process your order any further. If the Courses have already been paid for, we will refund you the full amount.
  1. APPLICATION AND PAYMENT
    • Booking implies a commitment to pay the published fees, subject to your eligibility for the course booked.
    • If your course requires you to have a particular qualification, you must confirm that you hold that qualification when enrolling.
    • Courses are paid for at the time of booking, with at least a non-refundable and non-transferable deposit being paid.
    • Deposits are non-refundable and non-transferable. For the avoidance of doubt, any deposits made for a particular course are linked to that course only. They cannot be moved, transferred or refunded.
    • For account customers payment of the balance of course fees (i.e. the total fee(s) less any deposit previously paid) is due no later than 30 days before the course starts or immediately if the course is due to start less than 30 days after booking.
    • Account limits are set a £2,000 maximum unless expressly stated otherwise, in writing, by Fast Line Training Services Managing Director
    • Failure to pay account balances within the above terms will automatically render them suspended
    • You can only pay for Courses using a debit card, credit card or PayPal. We accept the following cards: Mastercard, Visa and Visa Electron.
    • Further and subject to our agreement you may request delivery of an invoice from us and make payment for Courses by bank transfer or cheque (although full payment must usually be received in advance of access to the Courses).
  1. LATE PAYMENTS
    • Where payments are made by agreed instalments and those instalments have not been paid on the due date, we reserve the right to withhold booked courses. We reserve the right to suspend access to online accounts and/or treat the course as being cancelled. No refund of any course fees paid by you will be made. We also reserve the right to charge interest on late payments at a rate of 4% above the base rate from time to time of NatWest Bank as may be notified to you accruing on a daily basis until payment is made. If you are a business, we additionally reserve the right to claim interest under the Late Payment of Commercial Debts (Interest) Act 1998. 
  1. CHANGES AND CANCELLATIONS BY YOU
    • If you are a consumer and make a booking via our website or by telephone, you have a legal right to cancel a Contract under the Consumer Protection (Distance Selling) Regulations 2000) (‘Distance Selling Regulations’). Your legal right to cancel a Contract starts from the date when a booking is made – which is when the Contract between us is formed. Prior to the course, we would need 14 (fourteen) days notice if you wish to cancel your booking. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to enrol on a course, you can notify us of your decision to cancel the Contract and receive a refund.
    • If you exercise your legal right to cancel under the Distance Selling Regulations, you will receive a full refund of the price you paid when booking. We will process the refund due to you as soon as possible and, in any case, within 30 calendar days of the day on which you gave us notice of cancellation.
    • If your course is due to start within 14 (fourteen) days of when a booking is made, your legal right to cancel under the Distance Selling Regulations will not apply.
    • If, after the 14-day period referred to above has elapsed, but your course has not started, and you decide to cancel you will be liable for the full cost of the course.
    • If you are a business customer, you may transfer the booking to another candidate giving 7 days notice prior to the commencement of the course.
    • Any other changes for business customers are accepted at the discretion of Fast Line Training Services Limited and confirmed in writing.
    • When there is more than a 14-day notice period before your course is due to start, you can transfer your place to another date for the same course. The following conditions apply.
      • You can only make one transfer without incurring a £75 (+VAT) transfer fee
      • Exercising your right to transfer does not extend your 14-day cancellation period (i.e. when you transfer a course booking, you forfeit your right to the cancellation period if the transfer happens within the 14-day period of the original booking)
    • Please note that if anyone in your household has tested positive for COVID-19 at the time of your course, we ask that you forward their test result and we will move you to another date free of charge, in order to to ensure the safety of our delegates and staff.
  1. CHANGES AND CANCELLATIONS BY US
    • If circumstances arise that are beyond our control, it may be necessary from time to time to change/cancel course dates, content, venues and prices from those published. Whilst we will make every effort to transfer your booking to the next available course at your preferred venue, it should be noted that we will not be held liable for any costs/losses incurred as a result of any such changes. If we are no longer able to provide your course, we will ask you to return any course materials to us (at our expense) in the condition as originally delivered to you and refund to you any fees paid to date when we receive the materials as required.
    • We reserve the right to remove from any course, students that fail to comply with its standard practices and procedures. We reserve the right to refuse enrolments and/or suggest alternative arrangements if we believe that it will not be in the best interests of other participants and/or the individual concerned to be enrolled on one of our courses.
  1. PRICE OF COURSES
    • The prices of the Courses will be as quoted on our site at the time you submit your order. We take all reasonable care to make sure that the prices of Courses are correct at the time when they are entered into the system.
    • Prices for our Courses may vary from time to time, but changes will not affect any order you have already placed.
    • The price of a Course includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time being. However, if the rate of VAT varies between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Courses in full before the change in VAT takes effect.
    • Our site contains a large number of Courses. It is always possible that, despite our best efforts, some of the Courses on our site may not be correctly priced. If we find an error in the price of the Courses, you have ordered we will contact you to advise you of this error and provide you with the option of continuing to purchase the Course at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a miss-pricing, we do not have to provide the Courses to you at the incorrect (lower) price. 
    • Our No Pass No Pay guarantee only becomes applicable once the full course balance is paid. If the candidate fails the course they are on, and it's been paid for, we will put them on the same course at the next available date, free of charge. This is only applicable once (for the avoidance of doubt, candidates that fail can come on one more course, at our discretion, free of charge).  
    • If candidates fail the same course a second time, using the No Pass No Pay guarantee, we cannot move them again to another course free of charge. Any further course bookings will need to be paid in full. 
    • Non-attendance does not constitute failure and cannot be used under the No Pass No Pay guarantee. Any non-attendance will require full payment. 
    • Failure to meet any course pre-requisites (such as e-Learning, PPE, valid Drug & Alcohol or Medical, poor command of English Language) does not constitute failure and cannot be used under the No Pass No Pay guarantee.
    • Discount codes cannot be used concurrently at checkout. Only one discount code may be used at a time.
    • Any discount codes offered can be revoked or otherwise rescinded at Fast Line Training Service's discretion. Discount codes may also only be applicable for certain courses on certain dates.
  1. PERSONAL INFORMATION
    • Clients must provide an accurate and complete postal address, contact telephone number, e-mail address and National Insurance Number. We may refuse or cancel your enrolment if you do not supply these.
    • Your details will not be passed to any third party without your permission unless requested by law or a similar authority. The client’s age, sex and ethnic group may also be collected for NSAR (National Skills Academy for Rail) audits and accreditation.
    • Where your course fees are paid by your employer or other third parties you give us consent to share information about your progress and engagement on that course with that third party.
    • Fast Line Training Services Limited abides by the Data Protection Act and all other relevant Date Protection regulations (i.e. GDPR)

    • Fast Line Training Services Limited may contact you from time to time with products or information in which you might be interested. If you no longer wish to receive this information please contact us.
  1. LIABILITY AND CONTRACTUAL OBLIGATIONS
    • No other statements in the training materials, on the website or e-mail correspondence may be taken to imply any contractual obligation by Fast Line Training Services Limited.
    • Any liability will be limited to the payment of the enrolment fee paid, except in the event of personal injury or death at an event organised by Fast Line Training Services Limited.
    • Information, whether on the web or in any other form, is provided for the use of clients and others at their own discretion. No liability will be accepted for the accuracy of any information or the consequences of its use by clients or others.
    • Depending on the course purchased Fast Line Training Services Limited agrees to provide its clients with some or all of the following: Relevant course material, access to an online platform and appropriately qualified trainers.
  1. COMPLAINTS
    • If you have a complaint about any products or services provided by Fast Line Training Services Limited please contact us via the website or telephone 0208 596 5121. One of our managers will contact you within 10 working days.
    • The manager will investigate your complaint and aim to provide a satisfactory way forward within a further 10 working days, subject to the limits outlined in these terms and conditions. 
  1. END-USER LICENCE AGREEMENT (EULA)
    • Your use of our website is governed by our Terms and Conditions of Website use and Website Acceptable Use Policy. Please take the time to read these, as they include important Terms and Conditions which apply to you.
    • By accepting these General Terms and Conditions you also accept the terms and conditions of Website use and Acceptable Use Policy.

  1. GENERAL
    • These Terms are not intended to confer any benefit on a third party under the provision of the Contracts (Rights of Third Parties) Act 1999.
    • These Terms shall be construed and interpreted in accordance with the laws of England and Wales. The courts of England shall have exclusive jurisdiction in relation to any claim, dispute or other matters arising therefrom, without prejudice to Fast Line Training Services Limited right to bring proceedings in the courts of the country of residence of any user of the Website.
    • If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms which shall continue to have full force and effect.
    • The failure by us to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.
